1. Acceptance of Terms

Welcome to unsaken ("we," "our," or "us"). By accessing or using the unsaken mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App.

These Terms constitute a legally binding agreement between you and unsaken. By creating an account, you represent that you are at least 13 years old and have the legal capacity to enter into this agreement.

Geographic Service Restrictions

IMPORTANT NOTICE: The following users are currently unable to use unsaken until further notice:

European Union (EU) Users

Users located in the European Union (EU) are currently restricted from accessing and using unsaken. This restriction is in place because the developer has not yet accepted the Digital Services Act (DSA) agreement required for providing services to EU residents.

Affected regions include: All EU member states (Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, and Liechtenstein).

We are actively working to comply with DSA requirements and will update this policy once the service becomes available to EU users.

Israeli Users

Users located in Israel are currently restricted from accessing and using unsaken until further notice.

If you are located in one of the restricted regions listed above, please do not create an account or use the Service. Any accounts created from these regions may be subject to termination.

2. Description of Service

unsaken is a social networking platform designed to foster meaningful connections through:

AI-Powered Matching: Semantic matching technology that analyzes user profiles and interests to suggest compatible connections
Conversation Accountability: Structured conversation features including chat exchanges and engagement tracking
Interest-Based Connections: Profile creation with interests, MBTI AI-generated biographical information
Content Moderation: AI-powered content safety and community guidelines enforcement
Credit System: A pay-as-you-go model where users purchase credits to use the AI matching agent

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 13 years of age to use unsaken. Users under 18 should have parental or guardian consent before creating an account.

3.2 Account Creation

To use unsaken, you must create an account using one of the following methods:

Provide accurate, current, and complete information during registration
Maintain and update your profile information to keep it accurate
Keep your account credentials secure and confidential
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activities that occur under your account

3.3 One Account Per Person

You may only maintain one unsaken account. Creating multiple accounts may result in suspension or termination of all accounts.

4. User Content and Conduct

4.1 Your Content

You retain ownership of all content you submit, post, or display on unsaken, including:

Profile information (name, interests, MBTI type)
Conversation exchanges
Reports and feedback

4.2 Content License

By submitting content to unsaken, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with operating and improving the Service.

4.3 Prohibited Content and Conduct

You agree not to submit, post, or transmit content that:

Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
Contains unsolicited promotions, political campaigning, advertising, or solicitations
Contains software viruses or any other malicious code
Impersonates any person or entity or misrepresents your affiliation with any person or entity
Violates the privacy or publicity rights of others
Contains hate speech, discriminatory content, or incites violence
Involves harassment, bullying, or intimidation of other users
Exploits or harms minors in any way

You further agree not to:

Use the Service for any illegal purpose or in violation of any laws
Attempt to gain unauthorized access to the Service or other users' accounts
Interfere with or disrupt the Service or servers or networks connected to the Service
Use automated systems (bots, scrapers) to access the Service
Reverse engineer, decompile, or disassemble any part of the Service
Circumvent any content filtering or security measures
Collect or harvest personal information about other users without consent

4.4 Content Moderation

unsaken employs AI-powered content moderation systems to enforce our Community Guidelines. All user-generated content, including profile information and conversation exchanges, may be subject to automated and manual review.

We reserve the right to:

Review, monitor, and moderate all content
Remove or refuse to post content that violates these Terms
Issue warnings or suspend accounts for policy violations
Report illegal content to appropriate authorities

Violations may result in content removal, account warnings, temporary suspension, or permanent account termination.

5. AI Features and Data Usage

5.1 AI Matching

unsaken uses on-device semantic matching technology powered by Apple's Natural Language framework to:

Analyze user interests and profile information
Calculate match scores between users
Suggest potential connections based on shared interests and values

This processing occurs on your device and does not involve sending your complete profile data to external servers.

5.2 AI Content Generation

We use third-party AI services (currently Groq AI with models including Llama and Kimi) to:

Generate a personalized profile summary based on user profiles and interests
Create topic ideas
Generate chat pair questions for new connections

5.3 AI Content Moderation

We use AI-powered moderation (currently Groq AI with Llama models) to:

Review user-generated content for policy violations
Assess reports submitted by users
Detect inappropriate or harmful content
Assign severity ratings to reported content
Generate moderation summaries and recommendations

5.4 Data Sent to AI Services

When using AI features, we may send the following data to our AI service providers:

User profile information (name, interests, age, MBTI type)
Reported content and surrounding context for moderation purposes

Important Limitations:

Your data is NOT used to train AI models
AI services process requests transiently and do not retain your data
We implement strict data minimization, sending only what's necessary for each request
All AI processing follows our Privacy Policy guidelines

5.5 AI Limitations

AI-generated content and moderation decisions are not perfect. You acknowledge that:

AI suggestions and matches may not always be accurate or appropriate
Content moderation may occasionally produce false positives or miss violations
You are responsible for your own interactions and decisions on the platform
AI compatibility scores are estimates and not guarantees of successful connections

6. Matching and Connections

6.1 Matching System

unsaken's matching system presents potential connections based on:

Mutual interest alignment
Profile compatibility
Semantic similarity analysis
User preferences and settings

6.2 Connection Lifecycle

When matched with another user, you can:

Send messages through handshake chatbubbles
Build a friendship with conversation tracking
Select shared goals and create memory associations

6.3 Conversation Accountability

Certain features may include time-based expectations or deadlines for responses. Failure to engage within specified timeframes may affect your connection status or feed visibility.

6.4 Unfriending and Reporting

You may unfriend other users at any time. Unfriending a user will:

Prevent future matches between you and the unfriended user
Remove existing matches and conversations
Clear any active friendships or pending interactions
Restore your feed access if it was hidden due to the connection

You may report users or content that violates these Terms or our Community Guidelines. Reports are reviewed by our AI moderation system and may result in warnings, content removal, or account actions.

7. Credits and Payments

7.1 Credit System

unsaken uses a credit-based system for access to premium features, specifically the AI matching agent. Each time you use the AI agent to find compatible matches, one credit is consumed.

7.2 Free Credits

New users receive a limited number of free credits upon account creation. These initial credits allow you to experience the AI matching agent without any upfront payment.

7.3 Purchasing Credits

Credits are available for purchase through Apple's App Store as consumable in-app purchases
Credit packs (e.g., 50 credits) can be purchased at prices displayed within the App
Payment will be charged to your Apple ID account upon confirmation of purchase
Purchased credits are added to your account immediately after successful payment
Credits do not expire and remain available until used

7.4 Credit Usage

One credit is consumed each time you start the AI matching agent
Credits are non-transferable between accounts
Credits are tied to your device and persist across account deletions

7.5 Refunds

Credits are consumable digital goods. Refunds are handled according to Apple's App Store refund policies. We do not directly process refunds for credits purchased through the App Store.

7.6 Changes to Pricing

We reserve the right to modify credit pricing at any time. Price changes will apply to future purchases only and will not affect credits already purchased.

8. Intellectual Property

8.1 Ownership

unsaken and its original content, features, functionality, and design are owned by unsaken and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Trademarks

"unsaken" and associated logos and branding are trademarks of unsaken. You may not use our trademarks without prior written permission.

8.3 Third-Party Materials

The App may include third-party fonts, libraries, and content used under license:

Garet typeface
Heebo typeface
Firebase services
Apple frameworks and technologies

8.4 Copyright Infringement

We respect intellectual property rights. If you believe content on unsaken infringes your copyright, please contact us with:

Description of the copyrighted work
Location of the allegedly infringing content
Your contact information
A statement of good faith belief
A statement of accuracy under penalty of perjury
Your physical or electronic signature

9. Privacy and Data Protection

9.1 Privacy Policy

Your use of unsaken is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our Privacy Policy.

9.2 Data Security

We implement reasonable security measures to protect your account and personal information. However, no system is completely secure, and we cannot guarantee absolute security.

9.3 Data Retention

We retain your data for as long as your account is active or as needed to provide services. You may request deletion of your account and associated data at any time.

10. Third-Party Services

10.1 Authentication

We use Apple Sign-In and Google Sign-In for authentication. Your use of these services is subject to Apple's and Google's respective terms and policies.

10.2 AI Service Providers

We use Groq AI for content generation and moderation. Groq's processing of your data is subject to their terms and privacy policies.

10.3 Firebase

We use Google Firebase for backend services, including:

Cloud Firestore for data storage
Firebase Authentication
Analytics and crash reporting

Your data processed by Firebase is subject to Google's terms and privacy policies.

10.4 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites.

11. Disclaimers and Limitations of Liability

11.1 "AS IS" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

The Service will be uninterrupted, secure, or error-free
The results obtained from using the Service will be accurate or reliable
Any errors in the Service will be corrected
AI-generated content or matches will meet your expectations

11.2 No Guarantee of Connections

unsaken does not guarantee that you will make connections, find friends, or achieve any particular outcome from using the Service.

11.3 User Interactions

We are not responsible for the conduct of any user, whether online or offline. You are solely responsible for your interactions with other users. We do not conduct background checks on users.

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNSAKEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL UNSAKEN'S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO UNSAKEN IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless unsaken, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Your content or conduct on the Service

13. Termination

13.1 Termination by You

You may terminate your account at any time by accessing account settings within the App or contacting us directly.

13.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

Violation of these Terms
Violation of our Community Guidelines
Fraudulent, abusive, or illegal activity
Prolonged inactivity
At our sole discretion for any other reason

13.3 Effect of Termination

Upon termination:

Your right to use the Service will immediately cease
We may delete your account and all associated data
Outstanding financial obligations will remain enforceable
Provisions that by their nature should survive termination will survive

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which unsaken is registered, without regard to its conflict of law provisions.

14.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive or equitable relief in court.

By agreeing to these Terms, you waive your right to a jury trial and to participate in class action lawsuits.

14.3 Exceptions

Small claims court disputes and intellectual property disputes are exempt from arbitration and may be brought in court.

14.4 Notice of Dispute

Before initiating arbitration, you must first send written notice of the dispute to us, allowing 60 days for informal resolution.

15. General Provisions

15.1 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through:

In-app notifications
Email notifications
Updates to the "Last Updated" date

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

15.2 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and unsaken regarding the Service.

15.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.5 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.6 Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

15.7 Export Controls

You agree to comply with all applicable export and re-export control laws and regulations in connection with your use of the Service.

15.8 Language

These Terms may be translated into other languages for convenience. In the event of any conflict, the English version shall prevail.

16. iOS-Specific Terms

16.1 App Store

Your use of the unsaken App is also subject to Apple's App Store Terms of Service and Licensed Application End User License Agreement.

16.2 Device Requirements

unsaken requires an iOS device running a compatible version of iOS. We are not responsible for device compatibility issues.

16.3 Apple as Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms with respect to your use of the App, and Apple has the right to enforce these Terms against you.

16.4 Acknowledgment

You acknowledge that:

These Terms are between you and unsaken, not Apple
Apple has no obligation to provide maintenance or support for the App
Apple is not responsible for any product warranty claims
Apple is not responsible for addressing any claims relating to the App or your use of it
In the event of any third-party claim that the App infringes intellectual property rights, unsaken (not Apple) is responsible for investigation and defense
